Curtail Frivolous Lawsuits Filed Against Health Care Providers in Kentucky SB 119

While AMAC remains highly engaged with action being taken at the Federal level, AMAC also monitors important legislative movements at the State level.  Today, AMAC is pleased to draw attention to a sensible bill that was passed by the Kentucky State Senate.  SB 119 seeks to curtail frivolous lawsuits filed against health care providers in Kentucky by instituting a Medical Review Panel (MRP) process.  The mission of this independent, expert review panel is to evaluate proposed claims against providers and determine whether the medical standard of care has been breached.  As a result, MRPs rightly remove meritless claims that clog the judicial system and divert valuable resources away from patients in need of care.  In states like Indiana and Louisiana, MRPs have already been successful in reducing overall health care costs for consumers while maintaining high standards of medical care.  Additionally, 98% of AMAC poll respondents recently indicated their support for “health reform that institutes legal reforms of medical liability laws” as a way to drive down astronomical health care costs.  Thus, AMAC believes SB 119 is a critical first step in protecting the rights of patients, ensuring access to courts, and eradicating meritless lawsuits.  AMAC is proud to support SB 119 and will continue to advocate on its behalf as it moves forward in Kentucky’s legislative process.

Dear Honorable Legislator,

On behalf of the more than 1.1 million members of AMAC, the Association of Mature American Citizens, including the nearly 13,000 members residing in Kentucky, I am writing to offer our strong support for SB 119. This sensible piece of legislation seeks to curtail frivolous lawsuits filed against health care providers in Kentucky by instituting a Medical Review Panel (MRP) process.

Medical Review Panels provide an independent, expert review of proposed claims against health care providers. The purpose of the panel is to evaluate cases and determine whether the medical standard of care has been breached. Giving health care providers another layer of accountability in court, MRPs rightly remove meritless claims that clog the judicial system and divert valuable resources away from patients in need of care.

In other states across the country, MRPs have been successful in reducing overall health care costs for consumers while maintaining high standards of medical care. The establishment of MRPs in SB 119 will help to alleviate the medical liability burden that has drained Kentucky of vital caregivers and has perversely impacted patients and state government. When asked in a recent AMAC poll, an overwhelming 98% of poll respondents indicated that they “support health reform that institutes legal reforms of medical liability laws” as a way to drive down expensive health care costs.

SB 119 is a critical first step in protecting the rights of patients, ensuring access to courts, and eradicating meritless lawsuits.
