SCOTUS Upholds Health Care Law Under Tax Clause & Upholds Individual Mandate

The Supreme Court has upheld the mandate to buy health insurance — ruling that it is a tax and not a penalty as originally billed by supporters.

“The federal government does not have the power to order people to buy health insurance,” Chief Justice John Roberts wrote for a divided court. “The federal government does have the power to impose a tax on those without health insurance.”

The mandate requires people to have health insurance or face a considerable fine.

Starting in 2014, individuals must be insured or pay a penalty.

The amount of the penalty rises annually from 2014 to 2016 and is adjusted for inflation thereafter.

In 2014, the penalty will be no more than $285 per family or 1% of income, whichever is greater. In 2015, the cap rises to $975 or 2% of income. And by 2016, the penalty would be up to $2,085 per family or 2.5% of income, whichever is greater.

The dollar amounts for a single adult would be $95, $325 and then $625 during that same time period.

The mandate goes into effect in 2014 and is just one of the provisions that will help pay for the Affordable Care Act. The law will subsidize coverage for low- and middle-income Americans and expand eligibility for Medicaid. The federal government is set to spend more than $1 trillion over the next decade to do so. There are also a slew of spending cuts as well as other taxes and fees that will be paid by health sector companies and hospitals; employers and consumers.

Americans are outraged over the decision and must fight harder than ever if they want a change in the White House this November. To get rid of Obamacare, we must get rid of Obama.

i have been through 13 presidents so far, and have held high respect for 12 of them regardless whether they were dem. or rep. with this president , i have not one ounce of respect for him.

There is good news for Medicare beneficiaries in 2012.a0 A new Special Enrollment Period was cretaed by Medicare starting in 2012 that will allow Medicare beneficiaries to join a 5 star rated Medicare Advantage Plan or Prescription Drug Plan at any time during the year.a0 Currently, most beneficiaries are only allowed to sign up for a Medicare Advantage plan or Prescription Drug Plan during the AEP or Annual Election Period which runs from October 15 until December 7.a0 See my post on Medicare Advantage Enrollment Dates For 2012.

This man (Obama) was in deep water the day he went into office. How does a man without any experience in government other than not voting while in the Illinois’s legislature or in the US senate. Wait, I do think he voted for pro abortion legislation. I guess we got what those with their hands out for free stuff wanted. Now we will pay and they will pray that he stays in office. Wake up America!!

Obamascam is a complete deceit of the American people. After deceiving America for years now specifically stating this was NOT a tax, Obama sends his lawyers to the Supreme Court to argue that it IS indeed a tax (wink, wink, ;>) John Roberts could have dissented based on the language presented but chose instead to do the libs a favor and rewrite what he thought they meant all along, Then with the stroke of his pen he hopped in bed with the biggest scammer of our lifetime, Obama. All you 70+ folks out there, how does it feel today to be a “unit?”

I hope seniors are aware that at age 70 you become a “unit”
Units receive “Comfort Care” only. No heart valves, no knee or hip replacements. No service of any real value because you the unit are a financial burden to society.

Units need to vote out not just the president but the Senate.
If you want to live you have to vote against the current Democrats on all levels!

In the past most people stetard drawing their Social Security benefits at age 65 which corresponded nicely to the age of Medicare eligibility.a0 Unfortunately, the age for full retirement benefits from Social Security is going higher and currently can be as high as 67 for some people.a0 If you are drawing Social Security benefits when you turn 65 you do not have to do anything!a0 A full Medicare packet will be sent to you around three months prior to your birthday. Even if you are postponing your Social Security benefits, you have to still apply for Medicare when you turn 65.Source:

whats next ? food tax maybe windmills on your roofs and if not they’ll tax you. the groverment know can do anything to use as long as they put the word tax on it . we are done!!!!

You should be asking how will this affect ALL Medical care in America.

I know of several doctors who are not taking any new Medicare patients and I also know of 2 doctors who are retiring early because of Obamacare.

It does not take a rocket scientist to figure out what “more patients and fewer physicians” will do to Health Care of any sort in this country.
FYI- The Democrats have included in this program coverage for illegals.
