The Equality Act Poses a Grave Threat to Religious Liberty

AMAC Exclusive

Equality Act

The so called “Equality Act” is a top priority of Congressional Democrats, reportedly slated for a vote sometime this summer. The bill constitutes one of the most significant pieces of social legislation in decades, and it poses a grave threat to religious liberty. Here is what every American needs to know.

 What is the Equality Act?

The Equality Act would substantially change the Civil Rights Act of 1964 by incorporating “sexual orientation” and “gender identity” into its provisions.

The “Equality Act” would do two basic things:

  1. Prohibit “discrimination based on sex, sexual orientation, and gender identity in areas including public accommodations and facilities, education, federal funding, employment, housing, credit, and the jury system; and
  2. It would expand the definition of “public accommodations” to includes places that provide “exhibitions, recreation, exercise, amusement, gatherings, or displays,” along with “goods, services, or programs,” and “transportation services.”

In so doing, the legislation would grant sweeping new authorities to the federal government, including enabling the Department of Justice to intervene in any cases where there has been a claim of “discrimination” based on sexual orientation or gender identity. As the application of Civil Rights law in recent decades has shown, the government often takes a far more aggressive interpretation of such powers than ordinary Americans might imagine.

How Does it Pose a Danger to Religious Liberty?

The “Equality Act” is about anything but equality. Contrary to its claims, the legislation would not require everyone to be treated with equal dignity. Instead, it would force Americans to accept transgender ideology, regardless of their religious beliefs.

For example, any federally funded institution—including schools and colleges—would be compelled to treat men who identify as women as females, and vice versa. Anyone who would deny such ideas would be engaging in legally punishable “discrimination.”

And perhaps most disturbingly, under the new definition of “public accommodations,” churches, synagogues, and mosques could arguably be considered “public accommodations” as places that—according to the language of the “Equality Act”—provide space for “gatherings,” “displays,” or “programs.” The language is so vague that it would be theoretically impossible to exclude houses of worship from its provisions, and thus force religious people everywhere to violate their deeply held beliefs and convictions.

Additionally, the text of the act specifically denies that anyone can make a claim or defense against its provisions under “The Religious Freedom Restoration Act of 1993,” which prevents any department or official of either the Federal or any state government from “substantially burdening a person’s exercise of religion.”

In short, the “Equality Act” would clear the path for an unprecedented assault on religious liberty.

 Where Things Stand Now

The Equality Act was first passed by the House of Representatives in 2019, but stalled in the Republican controlled Senate. During the campaign, now President Biden promised to sign it into law within his first 100 days (now past), and his administration has endorsed it.

The House again passed the Equality Act in March 2021, and it is now up to the Senate whether it will become the law of the land, given Biden’s commitment to signing it.

As dangerous as this legislation would be to religious liberty, fortunately, the Supreme Court’s religious liberty jurisprudence is robust and strong. Just recently, the Court unanimously ruled in favor of Catholic Social Services in Philadelphia. When the city discovered that the Catholic adoption agency does not certify same-sex couples, based on its belief that a mother and a father are both necessary to the proper raising of a child, the city refused to contract with them. The Court ruled that this was prohibited discrimination, and warned against disparaging religious beliefs. Likewise, in the Masterpiece Cakeshop v. Colorado Civil Rights Commission case, the Court offered similar warnings.

For the sake of religious liberty, conservatives and Americans of faith must do all they can to prevent the passage of the Equality Act. But if Congress insists on passing this radical social engineering bill, there is reason to hope that the Supreme Court will hold the line on a fundamental constitutional right against the latest extreme left legislation pushed by Democrats.

The US Constitution specifically states the powers that are given to the Federal government, and that all other rights and powers are granted to the states and individuals. I don’t see anywhere in the Constitution where the Federal government is granted powers of social experimentation or enforcement of sexual identity that is based on anything other than birth or medical determination.

If the Equality Act should ever become a federal “rule of law”, it would not only subvert the human right of the majority of American citizens to be free to mutually agree in their social and commercial activities ___ it would allow federal bureaucrats to dictate almost every aspect of the American peoples’ social, religious and commercial activities, and compel the public at large to not only make every space open to the public a “safe space” where offensive sexual deviant displays are allowed, but it would actually compel the public at large to endure and even embrace, morally offensive sexual deviant behavior, expressions and proclivities, i.e., inclusiveness for our sexual deviant crowd, but not for those morally offended by sexual deviant behavior and expressions.

There is no “live and let live” and “freedom of choice” thinking in the Equality Act. It is designed to compel total submission to sexual deviant behavior, expressions and proclivities, regardless of how offensive they may be, religiously or otherwise.

Forewarned is forearmed.

And our children would not be safe either – being exposed to all of this stuff. They would also lose their freedom of movement in order to keep them safe from it. It’s just plain stupid and another way to control all of us. Won’t be long before they regulate everything we say and do if this keeps up

My friends and fellow Believers, with stuff like this it is best to remind yourselves that we serve a loving Father who will stand by us no matter what we will have to go through (Psalm 121:2, 124:8). Psalm 37 also addresses the plight of the righteous and the wicked and that one day the wicked and their ruling regimes will be no more! For all those who are not Believers, a warm and heartfelt thanks to you for your deep set convictions to stand against evil and for the great precepts and foundation for freedom this great land was built upon.

The fool has said in his heart, there is no God,
Send your child to public school, do you too applaud?
Where is every parental mass rally?
Zero, as I recollect as the last tally!
The secular humanists have taken control,
Public school teachers own America’s soul.
Footprint “so-called” is more than carbon in space,
Children have atheism’s foot stamped on their face.
Over and over and over again,
Deceive through evolution is their plan.
A return to God’s moral code,
Or an oppressive state is our abode.
The peripherals are important, indeed,
But how do we define human need?
The need for God, is universal,
Statism elevates man, Darwinian reversal.
No longer is murder a deviant sin,
Todays child sacrifice – a humanist win.
Honor thy father and mother,
Redefining family, these we must smother.
Again, where is every parental mass rally?
Zero, I recollect as the last tally.
Rejecting the Bible, behavior becomes gross,
Sodomy, now transgender – Satan’s double dose.
Depraved behavior there is no stopping,
Unless God and His principles do the cropping.
The economy and liberty are not the primary,
God or atheism, the battle is binary.
SALVATION, though living in a beleaguered nation.

I don’t reread any of my comments but probably should. In the sentence beginning with Zero, “as” should be “at”.

I have no doubt the SCOTUS will stop this nonsense dead in it’s tracks if it even gets that far, why wouldn’t they? After all they successfully managed to get Trump out of the picture with their proclamation of ” No Legal Standing ” with respect to the OVERWHELMING election fraud evidence presented to them of rampant election fraud in the presidential election…
All is good know where SCOTUS is concerned as now they are once again doing their job… :~(

Hard nosed advocates for religious freedom, like Bill Donohue of the Catholic League, are in the trenches every day fighting against this act.

What do you mean “the money they give the church”? Democrats don’t “give” ANY of their money to anyone, they only “take” from some to give to others, usualy “others” means thier pockets. If you look at how much charitable donations democrats show on their income tax returns it is 0 compared to what they earn.

The Democrats are merely working to re-make the United States into the mirror image of CCP controlled China and the old Soviet Union. The same policies of unlimited government control of all aspects of life is a common theme. Marxism is Marxism by whatever name you chose to call it to fool the people into accepting it. At the end of the day, the result is the exact same.

Paul, by considering religious institutions as “public arenas” the advocates of the “Equality Act” clearly attempting a back door assault on faith based organizations.
The smart money is on one of the houses of Congress flipping in 2022. If so this pernicious act won’t fly.

I pray that the Senate will not pass the “so-called” equality act. This would be one of the worst things that could happen to those of us who believe in the Bible and against this act.
